| The terms, policies and conditions (collectively known as "Conditions") described below govern the use of this site (referred to as "." or "site"). Your use and/or placement of any order indicate your acceptance of these Conditions. |
Customer Satisfaction:In general, we try hard to make you happy with your product purchase. Because of the costs associated with shipping these vehicles across the country, there are no returns or refunds on any vehicle purchases, but we will work with you to resolve any issues and take care of them quickly. We often provide parts free of charge outside of the warranty if there haven't been any issues with a customers bike. We replace plastic panels, seats, hand guards, many components that most sellers don't warranty at all. We try to make sure our customers are happy with their product. We aren't perfect, and sometimes we don't have the support of our supplier, but we do try at least.
We've been in operation since January, 2011. All online sellers claim to have brick-n-mortar dealerships, huge warehouses, parts and inventory on hand, and to provide support at any time. Have them prove it by providing pictures of themselves in front of their shop and/or inventory. We did this exact thing and you can meet us and visit our shop in our 'About US' page.
Warranty: Benelli, BMS, Hisun, Lance, and Linhai all have their respective warranties on their products and we recommend you visit those websites for warranty details.
Our vehicles have a limited, bumper-to-bumper, warranty against most defects for up to 12-months from the date of delivery on any of these products. Our warranty covers parts replacement only. There is no coverage for labor costs under any circumstance. Normal wear parts, labor costs, damage from negligent riding practices and damage from shipping are not covered by this warranty. Most plastic body coverings and the seat are covered under this warranty. All electronics including switches are covered as well as the entire drive train. Complete details of our warranty coverage is included with your purchase and can be viewed by clicking here. In 99.9% of cases, we will not have you return the failed part, saving you that cost, though we may ask for photographic evidence. And we ship the replacement part(s) covered by this warranty free of shipping cost as well.
Safety Warnings: These vehicles with the exception of youth off-road vehicles, are not for use by persons under 16 years of age and is to be operated in accordance with all city, state and federal traffic laws. Always wear eye protection, helmet and protective clothing. Remember to use good common sense and ride safe when operating these vehicles.
Disclaimer: Operating these vehicles involve some risk of serious bodily injury and/or death. Buyer accepts responsibility for any and all vehicle operation that may lead to personal injury, economic loss, social distress, other losses, costs and damages. Seller is not responsible for injuries and/or damages resulting from improper or unsafe vehicle operation.
Licensing & Registration: Although Laws vary from state to state, we guarantee that our on-road vehciles are legal for registration and operation in all 50 states (CARB Approved where specified). If you cannot register your vehicle, we will buy it back from you. Most other sellers have policies that amount to, 'it's your fault for not checking your local laws in regards to registering your scooter''. We think this is ludicrous. If the vehicle is truly DOT and EPA compliant, then it can be registered in any state other than California. And if it has CARB approval, it can be registered there. There is no reason why any seller's vehicle can't be registered, unless they aren't really DOT or EPA approved.
Jurisdiction of Sale: Any vehicle sale made by Viper Motorsports is a transaction completed in Lane County, Oregon and is subject to the laws of this jurisdiction. Which means, its the same as if the costumer had come to our facility, paid cash and took a product with them. Any legal action or court proceedings involving this transaction, Viper MotorSports and Sabre-Comm, Inc. and/or it's officers would have to take place in Eugene, Oregon.
Refund Policy: Due to the fact that you are buying a motor vehicle, there are no refunds or exchanges in any circumstance. It is the same policy if you purchased a new or used motor vehicle from any local dealer - there are no returns or refunds. The vehicle would be serviced and repaired under the warranty terms if applicable. Non-motor vehicle products may be exchanged for replacement parts at our cost in the event of a factory defect. There are no refunds allowed on special orders or electrical parts.
Shipping: Shipping to your residence with a lift gate may be included (based on vehicle size and weight) in the total selling price which also includes shipping insurance (02-22-2012) and the shipping cost varies from vehicle to vehicle. We can ship to Hawaii, Alaska or Puerto Rico for an additional fee over the total purchase price. Due to inventory logistics and scheduling shipment (or pick up) will generally be within 2-3 days for products in stock at the time of order. With optional complete assembly and custom crating, or having to source alternate brands, the ship time can extend to 3-5 buss days.
Refusal of Delivery: If the customer refuses delivery after shipment has been made, and there is no significant shipping damage, or the customer can no longer be reached by Viper Motorsports or the freight carrier, then there will be a reduction in the refund of the original purchase price to include shipping costs both ways and a 20% restocking fee. If there is a chargeback against a motor vehicle purchase for refusal of delivery, we will pursue legal action for contract breech and recovery of all fees and costs incurred to us.
Alternates and Substitutions: In regards to every vehicle that we sell, we will not ship a vehicle other than the exact make, model and color that you ordered unless we get your permission to do so first. In the event of a Part or Accessory purchase, we may substitute another brand for your Part or Accessory but only if it is of equal or greater value.

We accept money orders, cashier’s checks, personal checks, and company checks in U.S. Dollars only. Orders are processed upon receipt of a money order or cashier’s check. For personal and company checks, please allow up to 10 banking days after receipt for clearance of funds before the order is processed. We cannot guarantee the availability of a product by the time funds clear or payment is received. We will charge a $25 fee on all returned checks.

| For a multiple product order, we will make every attempt to ship all products contained in the order at the same time. Products that are unavailable at the time of shipping will be shipped as they become available, unless you inform us otherwise. You will only be charged for products contained in a given shipment, plus any applicable shipping charges. You will only be charged for shipping at the rate quoted to you on your purchase receipt. The entirety of this shipping charge may be applied to the first product(s) shipped on a multiple shipment order. |

| We will ship your product as it becomes available. Usually, products ship the same day if ordered by 5:00PM , or by the next business day if your order is received after this time and for orders received on Saturday, Sunday or any major holiday. However, there may be times when the product you have ordered is out-of-stock which will delay fulfilling your order. We will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. You may cancel your order at any time prior to shipping. |

| We will gladly accept the return of products that are defective due to defects in manufacturing and/or workmanship for 30 days from the date of purchase. Fulfillment mistakes that we make resulting in the shipment of incorrect product to you will also be accepted for return 30 days from the date of purchase. |

| Shipping Time -- Most orders received before 5:00PM will ship the same day, provided the product ordered is in stock. Most orders received after 5:00 PM will ship the next business day. Orders are not processed or shipped on Saturday or Sunday, except by prior arrangement.
We cannot guarantee when an order will arrive. Consider any shipping or transit time offered to you by Sample Store or other parties only as an estimate. We encourage you to order in a timely fashion to avoid delays caused by shipping or product availability. |

| Our Store shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the same state. For orders shipped to other states, you are solely responsible for all sales taxes or other taxes. |

| In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Our Store shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Our Store shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Our Store shall immediately issue a credit to your credit card account in the amount of the incorrect price |
